Introduction

1)     These terms and conditions (Terms) apply to the subscription service (Subscription Service) available on www.moltonbrown.co.uk (Website). Please read them carefully before signing up. If you do not agree to these Terms, you should not complete your order.

 

2)     All orders placed using our Subscription Service are also subject to our Terms and Conditions of Sale.

 

3)     We may update these Terms from time to time by publishing the revised version on our Website. The updated Terms will apply to all subscription orders placed after the date they are published.

 

4)     Unless otherwise stated, if there is any inconsistency between these Terms, our Terms and Conditions of Sale and any other communications (including our advertising or promotional materials), these Terms will take precedence.

 

5)     These Terms are written in and governed by the English language. Any translation provided is for convenience only (unless otherwise required by applicable law).

Your commitment

6)     By creating a subscription, you confirm you are:

 

a)     aged 18 or over;

b)     a UK resident;

c)      ordering products for delivery to a location we ship to (see Delivery for further information).

Subscription products

7)     Products eligible for subscription (Subscription Products) can be found here. You can also see if an item is available for subscription if the “Subscribe” option appears on the relevant product page.

 

8)     We may add or remove Subscription Products from time to time at our sole discretion. If a product you have a subscription for is removed, we will notify you by email, cancel your subscription for that product and refund any sums due.

Placing your first order

9)     You must be signed into your Molton Brown account to use the Subscription Service. If you do not have an account, you can create one here. Closing your account will automatically cancel your subscriptions.

 

10)  To order a Subscription Product using our Subscription Service, select the “Subscribe” option on the relevant product pages or in your basket.

 

11)  Choose your preferred delivery frequency using the drop-down menu then review your order and proceed to payment.

 

12)  You must complete all required fields in the online order form. Any personal data we collect will be processed in accordance with our Privacy & Cookie Policy.

 

 

13)  There is no minimum spend to join the Subscription Service and no limit on the number of Subscription Products you can subscribe for.

After you place an order

14)  After placing an order, you will receive an email from us acknowledging receipt. This does not mean that your order is accepted. Your order is accepted only when we send an email confirming your product(s) have been dispatched (Dispatch Confirmation). The contract between us for the sale of a product will only be formed when we send you a Dispatch Confirmation for that product.

 

15)  We may decline or cancel your order (in whole or in part) at any time, before or after sending a Dispatch Confirmation, at our sole discretion and without obligation to provide a reason, unless required by law. If an order is declined or cancelled, we will email you and refund any payment made for the cancelled items.

Subscription term

16)  When you create a subscription, orders for that product will be placed automatically at your chosen frequency until you modify or cancel your subscription. You can cancel at any time via your Subscription Dashboard. See “Cancelling your subscription service” below for more information.

Out of stock items

17)  If a Subscription Product is out of stock, we will notify you by email and remove it from your next scheduled order. You will not be charged.

 

18)  If the item returns to stock before your next order, we will: place a separate order for that Subscription Product, notify you by email, take payment and arrange delivery.

Discontinued items

19)  If a Subscription Product is discontinued, we will notify you by email and cancel your subscription for that product. You will not be charged. Any payment already taken will be refunded using your original payment method.

Subsequent orders

20)  When you sign up to our Subscription Service, you authorise us to charge your payment card at your chosen delivery frequency without any further action required from you.

 

21)  You will receive an email reminder four days before each subsequent order is processed and your payment card is charged. Orders will only be dispatched once payment is authorised.

 

22)  We may change the promotional benefits available as part of the Subscription Service. These changes will not affect any order for which a Dispatch Confirmation has already been sent. If changes impact future orders, we will notify you before your next payment, giving you the option to cancel.

***Payment***

23)  During checkout, you must provide valid payment details. Orders cannot be processed until payment is authorised.

 

24)  A valid Visa, Mastercard or American Express card is required. Other payment methods, including Klarna, PayPal, ApplePay and Molton Brown Gift Cards will not be accepted.

 

25)  Payment is taken at the time of your initial subscription order and at the point of processing for subsequent orders. As your subscription is an ongoing commitment, we securely store your payment details for future transactions unless you update them via the Subscriber Dashboard.

 

26)  If we are unable to process a payment, we will make two further attempts. The first attempt will be made 3 days after the initial attempt and the second and final attempt will be made 3 days after the first retry attempt. If both attempts are unsuccessful, the order will be rejected and you will be notified by email. Although your order will be rejected, your subscription will continue and a further order will be placed in accordance with your chosen subscription frequency.

 

27)  If three consecutive subscription orders are rejected due to unsuccessful payments, your subscription will be cancelled and you will be notified by email.

Payment with Loyalty Rewards

28)  Molton Brown Rewards Club members may use a loyalty reward as part-payment for their first subscription order only.

 

29)  Loyalty rewards cannot be used for the total value of the first subscription order as valid card details are required for subsequent orders.

 

30)  Loyalty rewards cannot be used for subsequent subscription orders because these payments are processed automatically.

Delivery

31)  Subscription orders will be delivered to the address specified in your initial subscription order unless updated in your Subscription Dashboard.

 

32)  All subscription orders benefit from free UK standard delivery. For the first subscription order only, you may select an alternative delivery option, such as Next Day Delivery, if available. See our delivery options here.

Reminder notices and cancellations

33)  After your initial order, you will receive a reminder email 4 days before each subsequent subscription order is processed.

 

34)  You may update your Subscription Service at any time via your Subscription Dashboard.

 

35)  Any changes or cancellations must be made at least 24 hours before your next scheduled order. If changes are made within 24 hours of the order being processed, your current order will still be charged processed in the usual way.

Returns

36)  If you wish to return a Subscription Product, please refer to our Online Returns Policy for more information.

Cancelling your subscription

37)  Unless as otherwise stated in these terms, your Subscription Service will continue until you cancel it. You may cancel at any time through your Subscription Dashboard.

 

38)  You must cancel at least 24 hours before your next scheduled order. If you cancel your within 24 hours, payment will still be taken and your order will be processed in the usual way. Reminder emails are sent 4 days before each order is processed and your payment card is charged.

Subscription benefits

39)  When you join the Subscription Service, you will receive:

 

a)     10% off your first subscription order; and

b)     10% off all subsequent orders for the same subscription.

 

40)  Unless otherwise stated, subscription benefits cannot be used in conjunction with any other offer or discounts.

 

41)  All subscription orders include free UK standard delivery.

Promotions

42)  We may offer promotions on selected products from time to time. Unless otherwise stated:

 

a)     subscription orders placed during a “no code needed” promotional period, such as our Friends & Family promotional discount period, will qualify for the promotional perk for that order only, provided the criteria for the promotion has been met;

b)     promotions that require a code for redemption will apply to your first subscription order only, provided the criteria for the promotion has been met. Code based promotions will not apply to any subsequent subscription orders.
